These Terms and Conditions ("Terms") govern your use of mybotbooker.com's services, website, and SMS communications program. By accessing our services or opting in to receive SMS messages from mybotbooker.com, you agree to be bound by these Terms. Please read them carefully.
1. Acceptance of Terms
By using any mybotbooker.com service — including our website, client portal, automation platform, or SMS program — you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, please do not use our services.
2. Services Overview
mybotbooker.com provides AI-powered operations automation services for home service contractors, including HVAC, plumbing, electrical, roofing, and general contracting businesses. Our services include, but are not limited to:
- Missed call text-back automation
- Review generation and reputation management tools
- AI-powered receptionist and intake (voice and chat)
- Lead follow-up and nurture sequences
- Seasonal campaign management
- Client portal for performance reporting and configuration
- SMS communications as described in Section 3
3. SMS Messaging Program
Program Description
mybotbooker.com operates an SMS messaging program to provide users with updates and notifications related to appointments, customer support communications, service updates, and other relevant information for users who opt in to receive messages.
Opt-In
By providing your mobile phone number and affirmatively opting in to our SMS program (via web form, verbal agreement, or other opt-in method), you consent to receive recurring automated text messages from mybotbooker.com. Consent to receive SMS messages is not a condition of purchasing any product or service.
Opt-Out Instructions
You can cancel the SMS service at any time. Simply text STOP to the short code. After you send the SMS message STOP to us, we will send you a confirmation SMS to verify that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you wish to join again, simply sign up as you did the first time and we will resume sending SMS messages to you.

Message & Data Rates
Message and data rates may apply for messages sent to you from us and to us from you. Message frequency may vary depending on your interactions with mybotbooker.com services. If you have questions about your text or data plan, please contact your wireless provider.
Carrier Disclaimer
Wireless carriers are not liable for delayed or undelivered messages.
Privacy
If you have any questions regarding privacy, please review our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. SMS opt-in data and consent will not be shared with any third party.
4. Acceptable Use
You agree not to use mybotbooker.com's services to:
- Violate any applicable federal, state, or local law or regulation
- Send unsolicited commercial messages or spam
- Harass, threaten, or harm any individual
- Transmit false, misleading, or deceptive content
- Infringe upon the intellectual property rights of others
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the integrity or performance of our services
5. Service Agreements and Billing
mybotbooker.com offers services under three engagement tiers (Audit, Build, and Retainer). Specific pricing, deliverables, timelines, and payment terms are set forth in a separate Service Agreement executed between mybotbooker.com and the client.
All fees are due as specified in the applicable Service Agreement. Late payments may result in suspension of services. All fees are non-refundable unless otherwise stated in your Service Agreement.
6. Intellectual Property
All content, software, designs, trademarks, and other materials made available through mybotbooker.com's services are the exclusive property of mybotbooker.com or its licensors. Nothing in these Terms grants you any ownership interest in our intellectual property.
We grant you a limited, non-exclusive, non-transferable license to access and use our services solely for your internal business purposes in accordance with these Terms.
7. Confidentiality
In the course of our engagement, both parties may receive access to confidential information. Each party agrees to keep the other's confidential information strictly confidential and not to disclose it to any third party without prior written consent, except as required by law.
8. Disclaimer of Warranties
mybotbooker.com's services are provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that our services will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee specific business outcomes, including lead recovery rates, revenue increases, or ROI figures. The estimates provided in our ROI calculator are illustrative only and based on industry averages.
9. Limitation of Liability
To the fullest extent permitted by applicable law, mybotbooker.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of our services — even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for any claims arising under these Terms shall not exceed the fees paid by you to mybotbooker.com in the three (3) months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless mybotbooker.com and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of our services, your violation of these Terms, or your violation of any rights of a third party.
11. Termination
Either party may terminate a service engagement as set forth in the applicable Service Agreement. We reserve the right to suspend or terminate your access to our services at any time, with or without cause, with or without notice, if we believe you have violated these Terms or applicable law.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Ohio.
13. Changes to These Terms
We reserve the right to update these Terms at any time. We will indicate the date of the most recent revision at the top of this page. Your continued use of our services after any such changes constitutes your acceptance of the updated Terms.
